Welcome to MemoriPlay. These Terms & Conditions ("Terms") are a legal agreement between you and MemoriPlay ("we", "us", or "our") and govern your use of our website, mobile app, and related services (together, the "Service").
By creating an account or using the Service, you agree to these Terms. If you don't agree, please don't use the Service.
You must be at least 18 years old to create a MemoriPlay account. By using the Service, you confirm that you are of legal age and able to enter into a binding agreement.
When you create an account, you agree to:
You can delete your account at any time from the app settings or by contacting [email protected].
You own your memories. Everything you upload to MemoriPlay — your recordings, photos, text answers, and personal stories (your "Content") — belongs to you.
By using the Service, you grant MemoriPlay a limited, non-exclusive, royalty-free license to store, process, and display your Content for the sole purpose of operating the Service and delivering the features you use (such as compiling your answers into a memory video or letting you share it with people you invite). This license ends when you delete your Content or your account.
You're responsible for your Content and promise that:
We reserve the right to remove Content that violates these Terms or our community standards.
MemoriPlay offers packages you can buy one-time. When you make a purchase:
Packages you purchase are granted to your account immediately and remain available to you as long as your account is active, subject to these Terms.
Because MemoriPlay delivers digital content immediately after purchase, sales are generally final. If you're unhappy with your purchase or experience a technical problem, email us at [email protected] within 14 days of purchase — we'll review your request and make things right when we can.
Please use MemoriPlay the way it's intended. You agree not to:
Your use of MemoriPlay is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. Please read it.
We work hard to keep MemoriPlay running smoothly, but we don't guarantee it will always be available or error-free. From time to time we may need to modify, suspend, or discontinue parts of the Service — for maintenance, upgrades, or other reasons. We'll give you advance notice of significant changes whenever we reasonably can.
MemoriPlay, including its logo, brand, design, code, and content we provide, is owned by us and protected by copyright, trademark, and other laws. You may not copy, modify, or use our intellectual property without our permission, except as needed to use the Service normally.
MemoriPlay uses third-party services (such as cloud hosting, payment processing, and analytics) to operate the Service. We're not responsible for those third parties or their terms. Your use of third-party services is governed by their own terms and privacy policies.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. To the fullest extent permitted by law, MemoriPlay disclaims all warranties, including merchantability, fitness for a particular purpose, and non-infringement.
We don't guarantee that the Service will meet your requirements, be uninterrupted, timely, secure, or error-free, or that stored data will never be lost. Please keep your own backups of irreplaceable content.
To the fullest extent permitted by law, MemoriPlay and its team, directors, employees, and partners won't be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total liability for any claim related to the Service won't exceed the amount you paid us in the 12 months before the claim arose, or $100 — whichever is greater.
You agree to defend, indemnify, and hold MemoriPlay harmless from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your Content, or your violation of these Terms.
You can stop using MemoriPlay and delete your account at any time. We may suspend or terminate your access to the Service if you violate these Terms, if we suspect fraud, or if required by law. On termination, provisions that by their nature should survive (like ownership, disclaimers, liability limits, and dispute resolution) will remain in effect.
These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in Delaware, unless a different forum is required by applicable law.
We may update these Terms from time to time. If we make material changes, we'll notify you by email or through the Service before they take effect. Your continued use of the Service after the changes go into effect means you accept the new Terms.
